Clark County Sheriff’s Office began their investigation Thursday near Kroger on U.S. 40 when Sgt. Ralph Underwood was flagged down by a resident who told deputies that someone in a car was flashing a firearm. An affidavit says Clark County Sheriff Deb Burchett was in the area and immediately assisted the deputy.
Underwood pulled the car over at the Speedway gas station in the area of Greenmont Avenue and East Main Street, the affidavit says. The men inside, including Cook who was driving, were detained.
Sgt. Underwood saw a face mask and a firearm in the vehicle, according to the affidavit.
The gun was loaded, the affidavit says.
“(A deputy) said the weapon did have a loaded magazine but did not have a round chambered. The weapon itself was not inside of any secured box or anything to prevent the gun from being accessed while the vehicle was in motion,” the affidavit says.

The affidavit says Cook told deputies the gun was his, but dispatch alerted them that the gun was stolen out of Cincinnati.
The passenger in the car was released but Cook was arrested at the scene.
“(Deputies) transported Cook to the jail where he maintained that he bought the gun from (a family member) and that he is sure that he and his brother have paperwork showing that the gun is legit,” the affidavit says.
A next court date had not been set in the case.
