Clark County Sheriff’s Office deputies began their investigation Sunday, Sept. 16 when they were called by a witness driving a gunshot victim to the hospital. The dispatch center collected information and found out that the shooting took place on the 2000 block of Ash Drive in the county, according to an affidavit filed with the charges.
“While at the scene on Ash Drive, Jacob advised he did shoot the gun,” the affidavit says. “He stated after shooting the gun he placed the gun and his ID card on the step outside his house by the front door.”
Mott told deputies he was out with his girlfriend when he was approached by the victim about stolen shoes, according to the affidavit.
“He advised (the victim) was trying to start an argument with him over some stolen shoes that happened six years ago,” the affidavit says. “Jacob stated his friends got him out of the bar but then (the victim) started calling his phone.”

Mott allegedly gave the victim his address and told him to come to his house if he wanted to talk about the shoes further. When Mott and his girlfriend arrived at his home, there were two cars there waiting for him, the affidavit says.
“Jacob stated his girlfriend dropped him off and he told her to go ahead and take his car and leave,” the affidavit says. “Jacob stated he went inside and retrieved his gun, a .38 that was inside a cloth holster that can clip to your belt or pants. He stated he went back outside and went into the street to confront (the victim). He stated they both started fighting in the roadway and both pushed each other against one of the cars. He stated as he was falling to the ground, he pulled his firearm. Jacob stated once on the ground, (the victim) was grabbing him and trying to grab his gun. He stated he did not know the gun went off until he heard (the victim) screaming and holding his side.”

The victim survived the gunshot, but had to undergo surgery, according to the affidavit. Deputies said through their investigation they found that Mott was in possession of a stolen gun, but it was unclear if that weapon was used in the shooting.
Deputies said in the affidavit this was not a case of self-defense. “The suspect walked into his home and came back out with the firearm,” the affidavit says. “He then approached the victim, leaving his property and going into the street where the incident took place. At no time did the suspect call the sheriff’s office for assistance prior to this incident which there was time to do since he went inside to obtain his firearm and go back outside.”
