Man was paralyzed after he fell down an elevator shaft

SPRINGFIELD — A man who was left paralyzed after falling down an elevator shaft in the Clark County Jail two years ago died this week, officials confirmed Tuesday, June 22.

Thomas A. Peck II, 34, of Springfield, died Sunday, June 20, at Kindred Hospital in Dayton.

The preliminary cause of death is undetermined, according to officials with the Montgomery County Coroner’s Office.

Determining a cause of death could take up to eight weeks, officials said.

Peck was left paralyzed after falling more than 30 feet down an elevator shaft in the Clark County jail after an alleged struggle with deputies in May 2008.

Peck later filed a lawsuit in federal court claiming that authorities threw him into a set of closed elevator doors after one deputy said, “(Let’s) open it with his face,” according to court documents.

Clark County Sheriff Gene Kelly, two deputies and Elevator Services of Kettering were named as the defendants in the complaint that asked for more than $25,000 in damages.

The claim against the deputies was dismissed last year as part of a settlement agreement.

Clark County Sheriff Gene Kelly could not be reached for comment Tuesday.

Deputies said the incident happened after Peck became upset about a meal tray, according to a sheriff’s report.

Peck threatened to stab deputies with a pencil and was pepper-sprayed and handcuffed before his fall, according to the report.

Visitation for Peck will be held at the First Assembly of God, 515 S. Burnett Road, from 6 to 7 p.m. Thursday, June 24, with a service to follow.
