He was not fined, but was ordered to remain under community control when released. Wolaver also ordered Burns be designated a Tier III sex offender for the rest of his life.
“I’m sorry for what I’ve done,” said Burns, who apologized to the victim, her family, the nursing home and his family.
Burns’ wife was in the gallery, as were supporters of the victim and representatives from Friends.
Burns said he had addictions for which he should have received help.
“These acts of Kevin Burns have left our community heartbroken,” said Tonya Diamond, Friends’ director of nursing. “We are still dealing with the ramifications of his actions. It will take us a long time to get over the actions of Mr. Burns.”
Burns was arrested after a July 16 incident in which he sexually assaulted a resident in her room at the center, 150 E. Herman St., in Yellow Springs.
The county prosecutor’s chief trial counsel, Jeffrey D. Hunter, said any improper acts committed by Burns with any other potential victims would be investigated, but may not lead to additional charges.
“The state will say that the defendant stepped up and acknowledged what he had done as opposed to dragging victims through a whole court process of a trial,” Hunter said. “That is a very closely knit community, and it has greatly affected their sense of security and safety.”
