According to a search warrant filed in Greene County Common Pleas Court, the girl was initially thought to be a runaway after her mother reported her missing on Dec. 30. Her mother later told police she thought her daughter was at the Knight’s Inn at 38 S. Allison Ave.
Xenia police dispatched three officers and later a detective to the location and found Hawkins’ vehicle there and confirmed that he rented a room.
Court records indicated the girl first was uncooperative with an officer, but then told officers she had sex with Hawkins, who was then arrested.
According to the search warrant that allowed officers to enter the motel room to seize property, they found an open bottle of rum, a marijuana pipe, condoms, clothes, bedding and other items.
Anger said Hawkins met the girl on a popular social online network. Hawkins and the girl are friends on Facebook, according to their accounts. The girl claims on her account she graduated from high school two years ago.
State law said a person is guilty of rape if they have sex with a person younger than 13 years of age, whether or not the offender knows the age of the other person.
“A 12-year-old doesn’t have the ability to give consent to (sex),” Anger said.
Hawkins’ first scheduled court appearance is Monday .
