UPDATE@4 p.m. March 3:

An autopsy was performed this afternoon on the 3-year-old Middletown boy who died after a “freak accident” last week, officials said.

The cause and manner in the death of Nicholas Minor probably won’t be released until the office reopens Monday morning, the Montgomery County Coroner’s Office said.

Meanwhile, his grandfather, Mark Minor, 60, who also was injured in the accident, was released today from Miami Valley Hospital in Dayton, officials said.

Initial report: A 3-year-old Middletown boy has died and his grandfather remains hospitalized after what has been called a "freak accident" Feb. 24 in the 4600 block of Shawnray Drive.

Nicholas Minor died Wednesday afternoon at Dayton Children’s Hospital, according to the Montgomery County Coroner’s Office. An autopsy, scheduled for Thursday, hadn’t been performed as of 3:30 p.m., officials said.

Nicholas’ grandfather, Mark Minor, 60, was listed in serious condition Thursday afternoon at Miami Valley Hospital in Dayton, officials said.

After Nicholas’ death, Middletown police met with the Butler County Prosecutor’s Office to determine if any charges would be filed against the driver, Jon Marshall Jr., 48, of Middletown. Lt. Jimmy Cunningham said Marshall will not face any criminal charges.

In the days after the incident, family and friends of the Minors asked for prayers and a miracle, according to their Facebook pages.

The accident occurred Feb. 24 after Marshall took his car to the Minor residence, where Mark Minor agreed to purchase the 2000 Grand Marquis, the police report said. When Marshall parked the car in the inclined driveway around 4:30 p.m. Feb. 24, a brick was placed behind the left rear tire, according to the police report.

Marshall said when the car wouldn’t start, he tried to put the car in gear, and that’s when it rolled backward.

The car jumped the brick, then ran over Nicholas, who was playing in the yard, according to the accident report. His grandfather tried to stop the car from hitting Nicholas but Mark Minor was struck in his pelvis, police said. He had surgery at Miami Valley for his injuries.
