Ex-New Carlisle councilwoman charged after Huber overdose death

A former New Carlisle City Councilwoman was charged with misdemeanors after an investigation into an overdose death in Huber Heights.

Rebecca “Becky” McKenzie, 36, was charged in Montgomery County Municipal Court with theft and criminal damaging. She is due in court on Feb. 18. A message left for McKenzie by this news organization was not returned Monday.

McKenzie was a New Carlisle City Councilwoman for about two months after winning a special election for the seat in May. However, she didn’t join the council until early June, and she then abruptly resigned in early August.

According to a report filed with the case, Huber Heights Police began their investigation into the overdose death of Justin Rock on July 11 when the man was found dead on his back patio.

McKenzie is not charged with Rock’s death, but rather she is charged in connection to Rock’s cellphone that went missing. Police say McKenzie took the phone from the home, smashed it, and then returned it to Rock’s fiancee.

The report filed in the case says Rock and McKenzie were friends and that Rock’s fiancee told police that McKenzie was called to the home shortly after Rock was discovered dead. The fiancee told police that McKenzie was acting “strange” during her time at the home.

“Becky had also taken Justin’s phone. She had smashed the phone, but returned it to the scene, telling (the fiancee) that she had been trying to protect her from Justin’s secret drug addiction,” the report says.

McKenzie also told police that she was trying to protect Rock and his family, according to the report. The report said McKenzie apologized several times to police for destroying the phone.

“(Police) were provided the phone belonging to Justin, which I observed had been destroyed to the point where microchips were loose and potentially missing,” the report says. “I consulted with a forensic phone examiner, who advised nothing could be done to process the phone due to its condition.”

During an interview with police on July 15, the report says McKenzie told police that Rock and she exchanged nude photos.

“Becky advised they had been flirting, talking and sending naked pictures of themselves, but they had never physically acted on them,” the report says.

The charges against McKenzie are theft, a misdemeanor in the first degree, and criminal damaging, a misdemeanor in the second degree.
