Osher has yet to be arraigned on the new charges in municipal court.
Felony murder is punishable by 15 years to life in prison, Sheriff Gene Kelly said.
Clark County Prosecutor Andrew Wilson said the new homicide case will be presented to a Clark County Grand Jury early next week and Osher will be indicted on new charges in Common Pleas court.
