Florida man accused of killing brother in fight over cheeseburger

A Florida man killed his brother Thursday night during an argument over a cheeseburger, police said.

Benjamin Middendorf, 25, called police around 10 p.m. and said he had just shot his brother, according to the Orlando Sentinel. Their mother can be heard shouting frantically in the background.

“My son just shot my son,” she is heard yelling. “How dare you Benjamin.”

Middendorf, who told police that he does not drink alcohol, said he was home when his mother and brother came home from the bar, according to the Orlando Sentinel. Middendorf said his brother started to bully him, and the two got into a fight over a cheeseburger.

Middendorf did not remember much more than that, according to the Orlando Sentinel.

On the 911 call, Middendorf can be heard shouting at the dispatcher that he was holding pressure on his brother’s chest.

“We were in a fight and I grabbed a gun and I shot him. Oh, my God,” Middendorf said. “I’m so sorry.”

Nicholas Middendorf, 28, was declared dead at the home.

Their mother can be heard saying: “I’m going to kill my son. I hope you go to jail.”

Benjamin Middendorf was arrested and charged with first-degree murder.

"It is Mother's Day weekend, and the mom has lost two sons," Denise Roberts, a spokeswoman for St. Cloud police, told CNN.
