Gary Kennedy, 66, was found with a gunshot wound in the couple’s kitchen in March.
Sheriff’s deputies responded to the couple’s home in the 8000 block of Township Road 110 in Rushsylvania in March on a report of a shooting. When they arrived, Logan County Sheriff Randy Dodds said they found Kennedy on the kitchen floor, dead from a gunshot wound.

Rosalie Kennedy said in court Thursday she was innocent despite a jury’s verdict in November.
“I’m innocent. I loved my husband. He was my world. He was my family. I miss my family every day. I grieve for him every day since he’s been gone,” she said tearfully.
Gary Kennedy’s family and friends were in court during the sentencing. One of his sons gave a statement and talked about the type of person he was.
“Gary was a truly unique human being who was kind, loving and hardworking and left his mark on the world,” Jason Kennedy said.
He added his father did not deserve the ending of life he was given. Rosalie Kennedy has been forgiven, the son said, but they will never forget.
Logan County Prosecutor Eric Stewart said the sentence was mandatory and could not be lessened.
“She will not be eligible for parole until she’s served 18 years because of the three-year gun spec,” Stewart said.
In a 911 call after Gary Kennedy’s death, Rosalie Kennedy admitted to shooting him, but her story has changed since then, Stewart said.
“The jury found the facts that were sufficient to find she is the one that did it,” Stewart said.
Attorney Tina McFall represented Kennedy during the trial and stated an appeal will be filed within the next 30 days. Her client pleaded not guilty, and she stands on that. McFall said there is not evidence to support an intent to kill.
Stewart said the appeal is automatic because of Rosalie Kennedy’s conviction and sentence.
“It’s really a tragic situation. Gary Kennedy is gone even with the conviction; it doesn’t bring Gary back. His family sorely misses him and they at least have some closure now,” Stewart said.
