SPRINGFIELD — Two companies are suing entities involved in building the Springfield City School District’s bus garage, according to documents filed in the common pleas court.
But the city schools and the Community Improvement Corporation of Springfield and Clark County are not responsible for the payments the companies are seeking, according to the parties involved. “It’s really a dispute between a contractor and a sub-(contractor),” said Jim Peifer, a local attorney who represent CIC, an economic development nonprofit organization.
Ohio Heavy Equipment Leasing filed suit against the city schools, Kapp Construction and the Ohio Farmers Insurance Company on Jan. 27, seeking $41,686.30 for work and materials they say they were not paid for, according to the complaint.
City Electric Supply Company, based in Montgomery County, filed suit against Kapp and Ohio Farmers, as well as the project’s electric subcontractors, Ideal Electrical Services and its owner, Taher M. Ahmouda. They are seeking $35,562.35 for supplies used in the project.
“I’m not sure that the board of education is even a proper party because the money is not coming directly from the board of education but from this outfit called the CIC,” said Thomas B. Talbot, Jr., the attorney representing City Electric.
An attorney for Ohio Heavy Equipment did not return a call for comment.
The dispute with Ohio Heavy Equipment is a disagreement over the amount of money due for services and supplies, said Randy Kapp, president of Kapp Construction.
“All the people involved are good contractors and good suppliers, and the project was a good job,” he said. “It’s just sometimes there’s a difference of opinion on who owes what.”
Springfield City School District opened the $1.7 million bus garage in August. It was built using permanent improvement funds and money left over from the district’s building project.
