According to court records, officials at the Clark County Jail were conducting a regular search of the pods in the jail when Shepherd was found sleeping on a daybed. When officers woke him up, they said Shepherd was reluctant to get off the bed.

Upon searching his jail-issued sleeping mat, officers allegedly found a green leafy substance believed to be marijuana concealed in toilet paper. Further inspection led officers to allegedly find a hole cut in the mat with a milk carton inside. Another clear bag containing the same leafy substance allegedly was found inside, according to reports.

Shepherd was questioned, but claimed the substances belonged to other inmates who left them inside the pod when they left the previous day.
