Local company embroiled in Louisiana lawsuit

A local manufacturer could be out more than $670,000 after its equipment reportedly cost a Louisiana contractor $1.9 million in damages.

United Fiberglass of America — a producer of fiberglass pipe, conduit and bridge drainage systems located at 907 Wheel Street — provided Louisiana contractor Jack B. Harper Contractor Inc. with defective equipment, according to court documents.

The contractor purchased multi-cell conduits and related items from United Fiberglass for a public works project for the Louisiana Department of Transportation and Development. In the original lawsuit against United Fiberglass and Oklahoma-based company Prime Conduit Inc., the contractor says the equipment failed to fit or function properly and had to be replaced with materials from another source.

And while United Fiberglass and Jack B. Harper Contractor battle in Louisiana courts, Ohio-based Central Mutual Insurance Company filed a complaint with Clark County Common Pleas Court saying it will not cover the fallout from the damaged equipment.

United Fiberglass officials said they could not comment on ongoing litigation. Attorneys from all parties were unavailable or would not comment on the case.

The damage from the faulty equipment is more than $1.9 million, including the cost of faulty equipment, delays and lost profit.

A jury convened in July and determined that United Fiberglass is at fault for 35 percent, or $670,493.60, of Jack Harper’s damages. The district court also ordered each party to give a proposed judgment determining who is most at fault for the $1.9 million fallout.

So far, the lawsuit has not been resolved.
