Sentencing hearing set for man who shot wife 'during sex'

Urbana, Ohio — A Springfield man who pleaded guilty to shooting his wife in November is scheduled to face a sentencing hearing in May, prosecutors said Wednesday, March 11.
Timothy S. Havens, 38, of Hillard Street in Springfield, pleaded earlier this week to charges of violation of a protection order, as well as one count of assault, said Nick Selvaggio, Champaign County prosecutor.
The violation of a protection order charge is a fifth-degree felony, while the assault charge is a first-degree misdemeanor.
A sentencing date is scheduled for 9:30 a.m. May 12, he said.
Although there were conflicting stories about the incident and authorities said evidence did not seem to match the story, Carolyn Havens has maintained that the shooting was an accident, Selvaggio said.
During a 911 call after the incident, Timothy Havens originally told authorities he accidentally shot his wife while they were having sex.
However, Carolyn Havens later told authorities it was an accident, but it did not happen during sex.
Timothy Havens will most likely be placed on probation, Selvaggio said.
