Husband arrested; wife still critical

URBANA TWP. — A man who told a 911 operator his wife was accidentally shot during sex was arrested Tuesday, Dec. 2, on felony charges of violating a civil protection order.

Timothy Havens, 38, of 859 Hilliard St., Springfield, was arrested three days after his estranged wife, Carolyn Havens, 42, suffered a gunshot wound to her chest, Sunday, Nov. 30. She remained in critical condition on Tuesday at Miami Valley Hospital in Dayton.

Carolyn Havens filed a civil protection order against Timothy Havens on Aug. 12. He was found guilty in September of violating that order and of assault. That prior offense elevated the current charge to a fifth-degree felony.

"Due to (the Nov. 30) alleged prohibited contact between the parties, the suspicious nature of the circumstances surrounding (her injury)" bond has been set at $75,000, said Champaign County Prosecuting Attorney Nick Selvaggio in a news release.

A 60-day sentence, which was suspended in September, was re-imposed.

The shooting itself is still under investigation, said Champaign County Sheriff Sgt. Matt Melvin.

The sheriff and prosecutor's office expect to present "the case in its entirety" to the Champaign County Grand Jury, which meets on Dec. 11, he said.
