Man convicted of possessing child pornography now charged with raping girl
DAYTON — A West Carrollton man sentenced to eight years in federal prison Tuesday, Sept. 22 for having child pornography on his computer has been indicted on sex charges involving a girl.
James Kevin Brown was indicted Sept 16 on five counts of rape of a child under the age of 13 and five counts of gross sexual imposition of a child under the age of 13, according to Montgomery County Common Pleas Court records.
The girl is a relative who is now 12, said Montgomery County Prosecutor’s Office spokesman Greg Flannagan. The alleged abuse dates back to August of 2004, Flannagan said.
The state’s investigation is not related to the federal case, Flannagan said.
Brown, 53, admitted to downloading the images from the Internet when he pleaded guilty to one count of possession of child pornography on July 23, 2007. On Tuesday, U.S. District Senior Judge Walter H. Rice sentenced Brown.
On March 26, 2007, West Milton computer repair shop workers found hundreds of child porn images when they were fixing Brown’s computer, according to information the FBI released Wednesday.
The employees called police, who seized the computer. When Brown returned the next day to pick it up, the employees phoned police, who took Brown in for questioning.
Forensic investigators at the Miami Valley Regional Crime Laboratory found 1,275 images of child pornography on the computer, the FBI said.
